Terms of Service

By creating an account or using AutoHelpX, you agree to these terms. If you do not agree, do not use the service. AutoHelpX is operated by [LEGAL ENTITY NAME].

You must be at least 18 and legally able to enter a contract. Providers and sellers must additionally hold every licence, permit and insurance their work requires, and must keep them valid.

AutoHelpX is a platform that connects people who need roadside help with independent mechanics, tow operators and parts sellers. We do not repair vehicles, tow vehicles, or sell parts. Providers and sellers are independent businesses, not our employees or agents.

The contract for any repair, tow or part is between you and that provider or seller. We are not a party to it. We review providers before approving them, but approval is not a guarantee of the quality, safety, timeliness or legality of their work.

AutoHelpX must not be relied on in an emergency. If anyone is injured, if there is a fire or a fuel leak, or if you are in danger, call [LOCAL EMERGENCY NUMBER] first. Dispatch depends on providers being available and online, and on your device having a working data connection, none of which we can guarantee.

Keep your credentials confidential; you are responsible for activity under your account. Give us accurate information and keep it current. Tell us immediately if you suspect unauthorised access.

• A request is an offer to engage a provider. It becomes binding when a provider accepts it.
• Location sharing must be enabled for a request to be dispatched and tracked.
• Cancellation is free before a provider accepts. After acceptance, a cancellation fee of [AMOUNT / RULE] may apply.
• Prices quoted in the app cover the platform fee. Parts and additional labour agreed directly with the provider are separate.

If you offer services or sell parts through AutoHelpX, you agree to complete our approval process and supply truthful documents; to perform work competently and lawfully; to honour accepted jobs or cancel promptly; to describe parts accurately, including condition and compatibility; and to hold appropriate insurance. We may suspend or remove you for repeated cancellations, safety concerns, fraud or unlawful conduct.

Listings are created by sellers, who are responsible for their accuracy. Stock and delivery times are estimates. Returns, warranties and defective goods are handled under [RETURNS POLICY / STATUTORY RIGHTS REFERENCE]. Raise a dispute in the app and we will help mediate, but we are not the seller.

• Payments are processed by [PAYMENT PROCESSOR]. By paying you accept their terms as well.
• Credits bought in the app are a prepayment for platform fees. They are [non-refundable / refundable on X terms] and [expire after X / do not expire].
• We charge a service fee of [FEE / RATE] per completed request, deducted as shown in your wallet.
• Refunds we approve are returned to your wallet or original payment method, at our discretion.

Do not use AutoHelpX to break the law; submit false requests or fraudulent documents; harass, threaten or discriminate against anyone; interfere with, scrape, reverse-engineer or overload the service; impersonate anyone; or arrange payment off-platform to avoid fees.

You keep ownership of the photos, reviews and other content you submit. You grant us a non-exclusive, royalty-free licence to host and display it for the purpose of operating the service. We may remove content that breaches these terms.

The service is provided “as is”. To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the service will be uninterrupted, that a provider will be available, or that estimated arrival times will be met.

We are not liable for the acts or omissions of any provider or seller, including damage caused during a repair or tow, or for indirect, incidental or consequential loss. Where liability cannot be excluded, our total liability is limited to [CAP, e.g. fees you paid us in the preceding 6 months].

Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

You agree to indemnify us against claims and costs arising from your breach of these terms, your misuse of the service, or, if you are a provider or seller, the work you perform or goods you supply.

You may stop using AutoHelpX and delete your account at any time. We may suspend or terminate an account that breaches these terms, or where we reasonably suspect fraud or a risk to safety. Sections that by their nature should survive termination (payment obligations, disclaimers, liability limits and indemnities) do.

These terms are governed by the laws of [GOVERNING JURISDICTION], and the courts of [COURTS] have exclusive jurisdiction. Please contact us first at [SUPPORT EMAIL], since most disputes are resolved without escalation.

We may update these terms. We will revise the date above and, for material changes, notify you in the app before they take effect. Continuing to use the service afterwards means you accept the revised terms.
